Privacy, Confidentiality and Professional Standards
Livian Consulting follows strict professional and legal standards to ensure that every assessment is carried out safely, fairly and independently. This page sets out how we manage privacy, confidentiality, data, independence and contact throughout the assessment process. It provides clarity for lawyers, agencies and families about how information is handled and what can be expected during an independent family law assessment.
Privacy and Confidentiality
Livian Consulting is committed to protecting the privacy of all clients, children and referrers. Personal information is collected only for the purpose of completing an assessment or preparing a report for the Court. All information is handled in accordance with the Privacy Act 1988, the Australian Privacy Principles and the professional ethical standards of the Australian Association of Social Workers.
Information provided during interviews or submitted through the referral process is stored securely and is accessible only to authorised personnel. Reports and documents are shared only with the commissioning lawyer, the Independent Children’s Lawyer or the relevant organisation. Livian Consulting does not provide copies of reports directly to parents or third parties.
Confidentiality is maintained within the limits of the law. Information may be disclosed if required by Court order, if there is a serious risk of harm to a child or another person, or if required by mandatory reporting obligations.
Independence
Livian Consulting operates as an independent expert service. Independence is essential for the integrity of all assessments. Parties do not communicate with the assessor outside scheduled interviews and administrative contact. No therapeutic advice, guidance or feedback is provided to any party. All assessments are conducted objectively and without influence from either side of a matter.
Reports are prepared in accordance with the Family Law Rules and the Expert Witness Code of Conduct. Findings and recommendations are based solely on evidence gathered through interviews, observations, document review and professional analysis.
Data Collection & Storage
Personal information is collected through referral forms, interviews, collateral documents, direct communication with lawyers and meetings with children and parents. Data may include contact details, family history, court documents, risk information and relevant psychosocial material.
All data is stored in secure electronic systems. Access is restricted to the assessor. Data is retained for the period required by law and by professional guidelines. After this period, information is securely destroyed.
Livian Consulting does not store financial information and does not process payments through the website. All payments for services are arranged through invoicing and bank transfer.
Use of the Website
The Livian Consulting website provides general information only. It is not legal advice and it is not a substitute for professional legal guidance. Reading or accessing website content does not create a client relationship and does not constitute the commencement of an assessment.
Any external links provided are for reference. Livian Consulting is not responsible for the content or accuracy of external websites.
Interviews and Safety
Interviews are conducted in a safe, neutral and child friendly environment. All parties are expected to behave respectfully during the assessment process. Aggressive behaviour, threats, harassment, intoxication or unsafe conduct may result in the appointment being stopped and rescheduled or cancelled at the discretion of the assessor.
If any party poses a risk of harm to a child or another person, appropriate action will be taken in line with professional and legal obligations.
Information Provided to the Courts
Reports prepared by Livian Consulting may be used in Court proceedings. Once a report is submitted, it becomes part of the Court process. Any questions about the content of the report must be directed through the commissioning lawyer or the Independent Children’s Lawyer.
Livian Consulting cannot alter a report once it has been submitted unless requested in writing by the commissioning lawyer and only where clarification is appropriate and professionally justified.
Fees & Invoicing
Fees for assessments are provided to the referrer before work begins. Payment schedules are discussed with the commissioning lawyer or agency. Livian Consulting does not accept direct payment from parents unless they are the commissioning party. All payments are handled through invoicing and bank transfer.
Complaints and Feedback
Livian Consulting takes all concerns seriously and encourages referrers to make contact if clarification or follow up is needed. A formal complaint can be made in writing to the practice. Complaints are addressed in line with professional standards and the Australian Association of Social Workers Code of Ethics.
If a matter cannot be resolved within the practice, individuals may contact the Australian Association of Social Workers for external guidance.
